I see that Credit Acceptance is one of your chapter 13 Lenders. Do they also require a “Motion to Incur Debt” letter from the judge/trustee before purchasing a car?
Unfortunately, the answer is yes. They do require the signed letter. In Washington it needs to be signed by the judge. I believe in some states, they allow a letter from the Trustee. It depends on your states procedures.
I went to a local dealership with my letter to incur debt. The court authorized me to purchase a new truck due to the nature of my job. I have a 660 credit score and still was denied credit. The bank supposedly told the dealership that the letter from my trustee wasnt worth the paper it was written on unless it included discharge papers. I dont know where to go from here.
Hey Walt,
Sorry for the delay. Just having the letter is not enough. You need to go to a dealership that actually specializes in Chapter 13 Auto Loans. Most dealers do not.
What state are you in?
